Hey kids, I was informed that one of my pics here was "borrowed" as a banner over at the comicboards.com (JLA forum) unbeknownst to me. I am okay, even flattered by this, as I explained to them, but the topic is getting heated over there. I'm pretty much done having said my piece, but I know how you guys like a good debate, so here's the url if you wanna chime in and help a brother out. (plus it's fun!) -Leif. I added my comments.
What a bunch of kids they are.
Notice at the end he says "fine I will take it down"
No one asked him to do that he just realized he screwed up and he was indeed trying to take credit for it.
There is no way you can use the justification that saying you created the banner just meant that you "borrowed" someone elses artwork and just made the banner.
Everyone that sees "created by" is naturally assuming that he created the work not Copied it.
Also I like how they try to play it off by saying they got it from a "banner maker" yet in one of the post the guy says "I".
What a bunch of frauds.
I don't have nearly the talents most of you here have as I am more a writer so I struggle just to get the crap I make on the screen so I can image how hard you guys work to get your results and I agree that you do deserve all the credit you can get and then some. _________________ www.jamica.org

The same thing happened to me back in January (certain little birdie informed me... )
The Spiderman mods seem to be a little more mature the the JLA ones....I didn't post any forum threads I contacted the mods directly, stating that the image was used without my permission as stated on my web page and that I didn't mind if they used the pic as long as they left my information on it (web address, signature etc...) if they did not I would prefer they remove the banner.
The one mod that made the banner said basically the same thing as yours.."we only credit the banner creator"...sorry..A few hours later I get an email from the head Mod saying he apollogized, currently wasn't able to ad a slug line, and would remove the banner.
He even went as far as posting a message/thread about banner submissions...see below
Quote:
E Pipes Up: Guys, when we make banners, we tread a fine line. Using art from the comics is arguably fair use. Using ORIGINAL artwork NOT produced for Marvel comics (by fan artists, professional or amateur) WITHOUT the permission of the artist (or with no credit given) isn't cool. Please attribute the images you don't snag from the comics, or we will be unable to use your banners. Thank you.
then this...
Quote:
hi mr moderator!
by this did you mean that if the artwork we use does not come from a comic then we must say who the artist is or it won't be eligible for use?
and lastly this
Quote:
I can handle this one...
Here's the deal. I went to somebody else's web site and snagged a few images (that he created) to be used into banners for our message board. The thing is, the images were used without permission and the proper credit wasn't given.
So, this new banner submission guideline was written because of me.
Any images created for Marvel (be it from tv, movies, books, or whatever) can be used here. Other sources (fan art and whatnot) are to be used with permission and the artist given their due credit before used for submission.

Sharby...
I don't have a problem with that. The guy even "manned up" and admitted he screwed up however unintentional. I don't know if it made you feel any better but at least it made more sence _________________ www.jamica.org

I wasn't upset at all, just like Junfan I was flattered someone actually used my work, the main guy was very professional about the whole situation and I told him in several emails we had that I appreciated how he handled it.
Now how it was handled in the JLA forum I think was a little childish/imature...but then again...I am old

If you are old then so am I.
One of the places I frequent where artists gather, have had a problem with something called TUBING.
People take other peoples art, zap the signature, delete elements of the artwork they don't like, add flourishes of their own and add THEIR signature to it. They make e-stationary and some have made collections TO SELL, trade etc.
Some Tubers have learned to ask permission. Alas, some think as the responses you've seen at the JLA Message Board. Copyright ignorance. (Some just do not care.)
I know they've done this at DAZ gallery, perhaps a notice here before entering the gallery (might have to catch clicks on the sidebar gallery preview) that the images here are property of the artist and are not to be used as clip art, tubes etc., without permission of the artists in question.

I personally found my older "Batman and Batwoman 2000" image (see my gallery) that I did some time ago, for sale on eBay, of all places, with the bid at the time toping out somewhere just over 300$ US.
My tag line on it was cut right out, and the guy had scribbled in his name.
Luckilly, every image I make, I keep the original Photoshop file of it, layers and all. When I contacted the seller, he said I was a liar, to @#$% off and get a life, that he spent two days making the image (It ook me 3 weeks), and he could sell it if he wanted to.
I contacted ebay, explained the situation, showd them a screen shot of the original Photoshop work, and then pointed them here and to Renderosity, where I have it posted.
Within an hour, his sale was shit down.
Never dealt with the banner issue. But hearing this, I should keep my eyes open I guess. _________________ =============================

Go Aremis.
Had something like this happen to a picture I was hosting for a friend of mine. I got an email telling me it had been spotted on a online casino gambling forum and someone was using it as his "corporate" logo. I told the creator, words were exchanged between the casino owner, and then between the creator and the host and the logo went away. _________________ "Flash, quit heckling the supervillain!" - Green Lantern

Heh - Sometimes its so diffcult. Im looking into possibilities of protecting my work using watermarks and Acrobat password. It makes it so its tiresome, and having to decide if one should post a full resolution version, stick to low resolution, which is a waste sometimes, or not even bothering sharing them online anymore.
I think i'll just continue being the bulldog that I am and attack anyone that uses my stuff =).

Sorry to be a bear about this topic, but the reply from the moderator has somethings that you may want to address here on this site.
He states that the place where he got the JLA image by JUNFAN says the images are in the public domain.
I dont recall seeing this here or HeroMorph.com.
I ask that perhaps a statement may be placed here to state that the artwork posted here is not in the public domain. Any other further protections you deem necessary please add.
That was a week long fight against the "creator" of the movies and convincing the owner of the website that he had be a victem of fraud.
Basically, a guy took a bunch of files from the 3dcc and made fan movies, that part is cool, but then when asked to give credit for the work, he claimed that they were all his files. A big no no.

I was going to dissect this guys argument to pieces, but I wonder if its worth the effort.
I think what gets me is the "We don't Credit the PROS, who are YOU to ask for credit." This is from the other moderator and not the one who COUGH*created*COUGH the banner.
The banner maker was rather defensive about what he'd done and crossed himself up a few times.
Again, perhaps a notice here that the artwork is copyright the creators of the artwork, dont use without permission.
